COURT CASE VS. DEAF SPORTS ANARCHISTS IS STILL ON

New York, USA – Another misleading and irresponsible propaganda statement is being launched by the Press Office of the autocratically-managed organization of the CISS/Deaflympics.

In its February 23, 2005 Press Release titled The U.S. Court of Appeals Rejects Pinchas' Appeal, among the other things, it is reported that "the Civil Action No. WMN-03-2690 is considered closed."

However, the truth is that plaintiff Mr. Pinkhasov Pinchas' defamation lawsuit/appeal case against defendants and deaf sports anarchists – Mr. Jerald Jordan and Ms. Donalda Ammons - is still being considered before the United States Court of Appeals for the Fourth Circuit in Richmond, Virginia.

In his two latest communications to the Richmond Court dated February 4 and 10, 2005, Mr. Pinkhasov Pinchas, has made his Petition for Rehearing En Banc and Motion to Reconsider Hearing En Banc, in which, among the other things, the following points and arguments are brought up:

- defendants violated nine ( 9 ) different rules of judicial system;

- defendants never submitted their Answer/Motion to Strike and Dismiss in an appropriate manner, including the fact that it took 121 days ( instead of the required 20 days ) for defendants to file such a Motion before the U. S. District Court for the District of Maryland in Baltimore, which was in a blatant violation of the Federal Rules of Civil Procedure;

- eight ( 8 ) different defamatory statements made by defendants against plaintiff were never acted upon by the Court;

- the Court in Baltimore in its August 2, 2004 Opinion Decision has failed to cite a single element, proof or fact that would clearly and soundly demonstrate the Court's conclusion that plaintiff indeed filed "a frivolous claim," and

- both Courts in Baltimore and Richmond have been treating defendants' attorney Kelby N. Brick preferentially and unpunishedly, in spite of his numerous failures to comply with federal and local rules of procedure as a lawyer for defendants.

Thus, the appeal case before the U. S. Court of Appeals in Richmond is still pending.

Meanwhile, as part of continued anarchical management in the organization of the CISS/Deaflympics by Ms. Ammons and her senior advisor Mr. Jordan, last month Ms. Ammons was herself elected as a new President of the organization in the anti-constitutional manner. This happened because Ms.Ammons' nominated organization - the United States Deaf Sports Federation ( USADSF ) - was ( and still is ) in violation of numerous rules of the CISS/Deaflympics' legal system. In addition, during the 2005 Congress and Deaflympic Summer Games held in Melbourne, Australia, more than seventy nine ( 79 ) rules of the CISS Constitution and Deaflympic Games Regulations were violated
